We are seeking an experienced Insurance Defense Attorney with deep expertise in claims and litigation concerning construction, engineering, and professional liability matters to support our growing portfolio of complex, technical projects.
Role Overview
This attorney will manage claims and litigation involving construction project claims, accidents, delays, and property damage as well as design claims including alleged errors and omissions and professional negligence. The role blends traditional insurance defense litigation with a business facing role requiring a close working relationship with engineers, architects, project managers, and insurance professionals to evaluate, manage and resolve claims. This position manages not only legal exposure, but also controls litigation costs, and protects the firm’s reputation.
Key Responsibilities
Litigation Claims Management
Manage a portfolio of construction claims, professional liability, and property damage claims from initial investigation through resolution.Develop litigation strategies and manage outside counsel through discovery, depositions, and the preparations for mediations, arbitrations, and trials.Mange, direct, and evaluate outside counsel to ensure cost‑effective, high‑quality representation of the company.Technical Forensic Analysis
Partner with in‑house engineers, architects, and technical experts to analyze project documentation to determine root causes of claims.Review drawings, specifications, change orders, schedules, daily logs, and site records to assess strategies for cost effect solutions related to project management, liability and damages.Support the engagement of experts and the preparation of expert reports.Insurance Contractual Risk
Analyze insurance policies (CGL, Builder’s Risk, Professional Liability) to determine coverage, additional insured status, and indemnity obligations.Advise on contract language, risk allocation, and project execution issues to prevent disputes and reduce exposure.Coordinate with insurers, adjusters, and brokers on claim strategy and reporting.Resolution Negotiation
Lead settlement evaluations, participate in mediations, and negotiate cost‑effective resolutions.Utilize ADR methods to resolve disputes efficiently and minimize business disruption.Risk Mitigation Advisory
Provide proactive guidance to project teams on OSHA compliance, safety incidents, documentation practices, and claims prevention.Identify trends and recommend process improvements, technology solutions, and training to reduce future claims.
