ACCOUNTABILITY OBJECTIVE:
The Associate Counsel – Employment & Litigation is responsible for working with company leadership to champion the Company’s mission, vision, values, and service standards. As a part of the legal team, this position is expected to work collaboratively with all levels of team members to improve the team member experience at Diversicare.
Position Summary:
We are seeking an experienced attorney with a strong background in employment and labor law to advise management on HR, employment and labor law matters, as well as assist on other general legal matters, including contract review. The ideal candidate will be a proactive, detail-oriented attorney who can manage complex legal issues while contributing to legal strategy and risk mitigation.
Key Responsibilities:
Advise leadership and HR on employment and labor law matters including discrimination, wage & hour, leave of absence laws (FMLA/ADA), and workplace policies.Draft, review, and revise employment agreements, separation agreements, NDAs, and other contracts.Represent the organization in administrative proceedings (EEOC, DOL, OSHA, state agencies).Manage employment-related litigation from intake through resolution, including discovery, motions, hearings, and settlement negotiations.In collaboration with outside counsel, serve as primary legal advisor on labor relations for unionized healthcare facilities, including collective bargaining strategy, contract interpretation, and administration.Lead or support negotiations of collective bargaining agreements with multiple unions, as well as manage grievance and arbitration matters arising under collective bargaining agreements.Assist with other non-employment litigation, as well as other corporate legal matters such as contract review, vendor agreements, and internal policies.Prepare legal memoranda and training materials for internal audiences. QualificationsQualifications:
Juris Doctor (J.D.) degree with a license to practice law in good standing in at least one U.S. state; admission to the Tennessee Bar is preferred.5+ years of litigation experience, with a focus on employment and labor law.Strong contract drafting and review skills.Excellent legal research, writing, and analytical abilities.Proven experience managing litigation and administrative matters.
