Job Title: Assistant General Counsel - Dispute Resolution

SUMMARY:

  The position is responsible to oversee the organization’s captive insurance program’s litigation and claims management program. The role also provides strategic support, direction, development, implementation, and maintenance to the system-wide corporate risk management program.

RESPONSIBILITIES:

 

People Leadership

Recruit and retain talent to support business needs; foster a collaborative, team-based culture.

Monitor and recognize staff performance; support professional growth and development.

Promote workplace safety, well-being, and engagement.

Provide operational guidance and answer day-to-day team questions.

Operations

Oversee daily management of Captive Professional and General Liability litigation and claims.

Lead litigation monitoring, strategy, and defense counsel management.

Handle claims, mediations, settlement conferences, and alternative dispute resolution.

Ensure compliance with Section III, NPDB reporting, and regulatory audits/investigations.

Conduct legal research and respond to legal/risk inquiries.

Risk Mitigation

Lead corporate risk management to reduce organizational exposure across multiple insurance programs.

Implement loss prevention initiatives for liability, property, cyber, workers comp, and other risks.

Manage claims from identification to settlement, including reserves, strategy, and negotiations.

Collaborate with senior legal leadership on high-dollar/high-risk cases.

Coordinate with counsel, TPAs, and risk programs to resolve claims via settlement, mediation, arbitration, or trial.

Insurance and Claim Administration

Manage insurance selection, negotiation, and annual renewals with brokers/agents.

Independently negotiate and settle claims pre-litigation; determine when legal counsel is needed.

Partner with hospital staff and leadership to provide real-time risk and safety guidance.

Triage events and escalate to outside counsel when appropriate.

Performance Improvement

Recommend strategies to reduce medical errors and adverse patient outcomes.

Develop policies, procedures, and programs to improve safety for patients, visitors, and employees.

Collaborate with leadership to implement corrective actions, improve satisfaction, and reduce litigation.

Analyze safety events and near-misses to prevent recurrence and educate providers.

Actively serve on multiple committees (Ethics, Quality & Safety, Grievance, etc.) and report metrics to leadership and the Board.

Oversee development of risk management training, educational materials, and workforce safety programs.

Direct strategic policy development, corrective action planning, and compliance with clinical documentation and patient rights standards.

REQUIRED QUALIFICATIONS:

Juris Doctorate

7+ years of medical malpractice defense or general civil liability (insurance defense) legal experience required; or, acting in the capacity of in-house legal counsel or VP-Risk Management managing such litigation

 

PREFERRED QUALIFICATIONS:

New York State medical malpractice defense legal experience

Knowledge of healthcare quality, regulatory, compliance and accreditation standards

Knowledge of clinical documentation, risk management and confidentiality requirements

Strong leadership, communication, negotiation skills. Excellent written, oral, and presentation skills.

$115,000.00 - $175,000.00

The listed base pay range is a good faith representation of current potential base pay for a successful full time applicant. It may be modified in the future and eligible for additional pay components. Pay is determined by factors including experience, relevant qualifications, specialty, internal equity, location, and contracts.
