Assistant General Counsel – RE & Commercial Litigation
The **Assistant General Counsel – Commercial and General Litigation** has responsibility for managing the defense of litigation, including commercial, consumer class actions, real estate, product liability, regulatory matters, and other disputes that may arise. The incumbent is responsible for identifying related issues within the Company and providing advice, training, and counsel to internal business partners, including Merchandising, Supply Chain, IT, Finance, Real Estate, and Store Operations on a variety of compliance issues. Regular travel throughout the continental U.S. is required. **Principal Duties and Responsibilities** • Actively manage various types of litigation for the Company. • Select and actively monitor outside counsel to ensure effective case handling, with an emphasis on efficiency and cost consciousness. • Conduct investigations to respond to complaints and lawsuits. • Provide advice and counsel to business partners. • Identify risks to the business and ensure compliance with laws and regulations. Stay abreast of legal trends and communicate proactively to internal partners and clients. • Represent the company at trials, hearings, investigations, depositions, mediations, and settlement conferences. • Identify and pursue opportunities for the Company to recover funds, including through litigation and class claim participation. • Oversee, and as necessary prepare, the response to notices, subpoenas, summonses, and other correspondence that require legal action in incumbent’s areas of responsibility. **Minimum Requirements/Qualifications** • JD from accredited law school and license to practice law. • Bar membership and in good standing with at least one state and eligible to be issued a Virginia Corporate Counsel Certificate, if not a member of the VA Bar. • 7-10 years’ experience in commercial and class action litigation. • Strong oral and written communication and negotiation skills and analytical ability. • Ability to work successfully with business partners throughout the Company. • Ability to travel regularly throughout continental United States. **Desired Qualifications** • Experience with retail companies. • Experience with product liability and intellectual property litigation. • Experience working with Fortune 500 companies.
